Glitter Import Ban: EU Regulation No. 2055 in force from 17 October
On 27 September, EU Regulation No. 2055 was published, coming into force on 17 October as an amendment to the REACH regulation governing chemical substances, EU Reg. No. 1907/2006.
This intervention by the European Union represents a significant move in the fight against environmental pollution, focusing specifically on microplastics. The regulation targets tiny fragments of chemically modified or synthetic natural polymers, insoluble in water, which degrade slowly and can harm the environment and potentially human health.
The European Chemicals Agency (ECHA) conducted a study that highlighted the uncontrolled release of microplastics intentionally added to certain products, thus recommending the need to limit their use.
The regulation imposes a ban on the entry onto the market of specific types of polymers, both pure and in mixtures with other substances. Particles of synthetic polymers smaller than five millimeters, organic, insoluble and resistant to degradation are affected. This restriction affects a wide range of products, including granular material for artificial sports surfaces, cosmetics, detergents, glitter, fertilizers, plant protection products, toys, medicines and medical devices.
The regulation establishes an in-depth regulatory framework with transition periods and exemptions linked to certain uses of substances. Key provisions include limits for synthetic polymer microparticles and exemptions for certain sectors such as medicines, foods, and in vitro diagnostic devices.
The regulation's requirements will begin to apply on October 17, 2023, with some provisions coming into force later for specific sectors such as cosmetics, medical devices and makeup products.
Implications for Businesses:
For companies that import or market products subject to this regulation, it becomes essential to carefully analyze their products in light of the requirements indicated in the regulation. In order to avoid customs stops, seizures of goods and sanctions, it is necessary to understand and respect the provisions of the regulation, evaluating any transitional periods and exemptions.
